1. Easy dd™
alerts – Terms and Conditions
1.1
These Terms
and Conditions apply only to the easy dd™ alerts service.
In this agreement “we”, “us” and “our” mean directdebit.co.nz
and “you” and “your” mean the easy dd™ alerts member
who becomes registered with us to use easy dd™ alerts.
1.2
All easy dd™
alerts that are sent to registered members of directdebit.co.nz
are deemed to have been sent with your acceptance of
any applicable terms and conditions.
2. Registration
of your mobile phone
2.1
When you register
for easy dd™ alerts you will be asked to nominate a
mobile phone number so that you can receive your easy
dd™ alerts by way of text message. At this stage, you
must inform us who the owner of the nominated mobile
phone. You can only register one mobile phone number
for easy dd™ alerts.
2.2
We can only provide easy dd™ alerts to residents of
New Zealand.
2.3
We can only
provide easy dd™ alerts by way of text message to a
mobile phone registered on a New Zealand network being
either Telecom New Zealand, Vodafone, Telstra Clear
or 2o degrees. Some older mobile phones may not be compatible
with easy dd™ alerts. [the nominated mobile phone must
be a digital mobile phone]. If you are unsure please
contact your service provider.
2.4
When you register
for easy dd™ alerts you must either be the owner of
the nominated mobile phone or else have the permission
of the person whose responsibility it is to pay the
phone bill of the nominated mobile phone.
2.5
In the case
of a mobile ownership dispute over an easy dd™ reward,
it is the responsibility and full cost of the owner
to prove such ownership.
3. Easy dd™
alerts
3.1
When you register
for easy dd™ alerts we will send you the direct debit
information by way of text message to the nominated
mobile phone or by way of email to the nominated email
address.
3.2
You must tell us as soon as possible if you receive
any easy dd™ alerts that appear to be irregular.
3.3
We may have
to interrupt the easy dd™ alerts service, for example
to carry our maintenance or in circumstances beyond
our control, but we will try to keep such interruptions
to a minimum.
3.4
We will only
send you each easy dd™ alerts message once. If you delete
one of our easy dd™ alerts text messages or emails we
cannot send it again.
3.5
Delivery times
for the easy dd™ alerts may vary and are subject to
network coverage and availability, entry volumes, the
memory of the SIM card inside your mobile phone not
being full and/or any technical problems.
3.6
We may send
you, by post or email, from time to time, information
about the easy dd™ alerts service explaining how the
easy dd™ alerts service works and any steps that you
need to take in relation to the service.
3.7
We reserve
the right to add or delete a promotional message to
each easy dd™ alerts message without notice.
4. Your obligations
4.1
You are responsible
for providing and maintaining the nominated mobile phone
number or email address and ensuring connection to a
network suitable for receiving the service from us.
4.2
You must tell
us immediately if your nominated mobile phone is lost
or stolen, or if you change your nominated mobile phone
number or email address. If you do not tell us we will
continue to send the easy dd™ alerts to the nominated
mobile phone number or email address. We will not be
liable in such circumstances.
4.3
You should
take all reasonable steps to prevent unauthorised access
to confidential information stored in your mobile phone,
or prevent your mobile phone from being used if it is
lost or stolen.
5. Liability
for loss
5.1
In times of
high easy dd™ alerts volumes some delays may occur in
the delivery of the easy dd™ alerts. We will take reasonable
care to ensure that all easy dd™ alerts are sent to
you as scheduled and are accurate. However, we cannot
guarantee that you will receive the easy dd™ alerts
as successful delivery depends on the service provided
by the network provider of your nominated mobile phone
or email address as well as geographic, atmospheric
and other conditions and circumstances beyond our control.
Message delivery performance is subject to the recipient's
mobile terminal being switched on and located within
an area that is acceptably covered by the recipient's
service provider. Furthermore, mobile operators can
prevent their subscribers from receiving text messages,
for whatever reasons, and in such cases message delivery
is not possible. Directdebit.co.nz, partners and mobile
operators will not be held responsible for any loss,
damages or injury whatsoever arising from the receipt
or non-receipt of text messages. If we can show that
an easy dd™ alerts message was sent by us to you then
we shall have no liability to you if you suffer loss
due to the easy dd™ alerts not being received accurately
or at all.
5.2
Should there
be a dispute, we shall endeavour to make the necessary
investigations to the best of our abilities and attempt
to rectify the discrepancy, but should such investigations
prove to be inconclusive, no further action can be taken
against us or easy dd™ partners or the mobile operators
by easy dd™ alert members.
5.3
We will not
be liable to you in any circumstances for any type of
special, consequential or indirect loss whatsoever suffered
as a result of easy dd™ alerts not being sent.
6. Variation
6.1
We may vary
or update these Terms and Conditions at any time.
7. Termination
7.1
You must contact
us direct if you wish to withdraw from the easy dd™
alerts service.
7.2
We can decide
to withdraw the easy dd™ alerts service by giving you
at least 10 days notice in writing to you. We can decide
to withdraw the easy dd™ alerts service immediately
without prior notice to you in order to comply with
the law, to protect security or to combat fraud.
7.3
We will withdraw
the easy dd™ alerts service if we receive information
from your service provider that your contract with them
has been cancelled.
7.4
We reserve
the right to verify the validity of any easy dd™ alerts
and may at our discretion suspend the membership if
we feel that the easy dd™ alerts system is being misused
in anyway.
8. Disclosure
of Information
8.1
By registering
to receive easy dd™ alerts you agree that we may use
the information given to us in our internal systems.
This may be used by us for assessment and analysis and
so that we develop and improve our services to you and
other customers and protect our interests.
8.2
We may give
information about you in the following circumstances;
8.2.1
To people who
provide a service to us or are acting as agents, on
the understanding that they will keep the information
confidential.
8.2.2
To your network
provider
8.2.3
If we are required
to give the information for legal reasons.
9. Law covering
this agreement
9.1
This agreement
is covered by the law of New Zealand.

10.1
Any complaints
or queries about the easy dd™ alerts should be addressed
